Yes we know its the boring legal stuff but please make sure you have read and understand these T&C’s prior to confirming any orders with Essex Rotary LTD, By placing your order with Essex Rotary LTD you confirm you agree to be bound by our Terms and Conditions of sale below.

Please note that all prices shown are include VAT but exclude Delivery (unless in the case of Delivery costs it is otherwise stated).

1.Payments, Taxes and Pricing

1.1 – Payment Options and Further Security

We accept all major credit and debit cards, processed via PayPal. We are also able to offer payment via BACS on request.
We will not send out any goods until payments have cleared through the banking system.
For high value orders where payment has been made via PayPal we reserve the right to hold your order until PayPal and Essex Rotary  are certain that the transaction is not fraudulent.

1.2 – Credit Card Security

Please be assured that all orders placed using credit card/debit card payments are encrypted using 128-bit encryption and are handled using Paypal’s Secure Servers. They are only decrypted after they reach our computer. They are not held in clear text on any web site. Your important card information is never available to any of the Team here at Essex Rotary .

1.3 – VAT (Value Added Tax)

VAT is charged on all UK and EU orders, and is included in the advertised prices found on this website.
VAT is calculated and charged at the appropriate current UK rate of Value Added Tax.

VAT for Non UK/EU Orders
For Non EU orders VAT will be deducted from the advertised price upon the creation of your invoice for payment.

2 – Delivery Costs

2.1 – Non Mainland Addresses

Delivery Costs on our store are calculated for Mainland UK, in some cases if your delivery location is considered as “Remote” or “Highlands & Islands” There is usually an additional charge to delivery, due to the varying nature of delivery rates to these locations this needs to be priced on an individual basis.
In these cases we would advise contacting us prior to placing your order so that we may confirm your delivery cost.

2.2 – International Orders

Delivery outside of Mainland UK Must be handled on a bespoke basis, Due to the varying rates for different countries.
In order to advise of the cost of delivery of your goods outside of Mainland UK  please email us sales@essexrotary.co.uk
Please include a list of the goods you would like to order and your full delivery address (including country).

2.3 – Reasonable Delivery Costs

Every effort will be made to ensure the delivery cost quoted for your international order is competitive, in some cases if available to us we will offer your multiple delivery options with varying rates and delivery time estimates.

3. Delivery of Goods

Here at Essex Rotary we are not just an online store, Please try to remember we also run our Workshop, So while every effort is made to process your order in a timely fashion, when parts are in stock.

3.1 – Delivery Times for In stock items.

Typical processing times are 7 days. However In most cases please allow up to 28 days for delivery, unless otherwise stated in the item description such as special order items.  28 days is typically sufficient time for Essex Rotary Order in parts that are out of stock, If we suspect this process will take longer than the 28 days Essex Rotary will contact you to inform you of this delay. Please note that special order parts are excluded from our typical 28 day delivery expectation (Please see below)

3.2 – Delivery of Special or Made to Order Items

In cases where your parts are special order or made to order, this is normally stated at the bottom of the products description.

Including but not limited to:

  • Exhaust systems
  • Exhaust systems
  • Induction or turbo kits
  • Nitrous Kits or Components
  • ECU’s  (Engine Control or Management Systems)
  • Wheels and or Tyres
  • Final Drive Ring and Pinion Sets
  • Water/Methanol Injection Kits and Components
  • Etc.

Estimated delivery times can vary and the expected lead time is published as a guide only, Delivery may be faster however due to the nature of some of the items we offer for sale coming from outside the UK, delivery times may be longer in cases where delays are out of our direct control
For example your ordered parts are held for customs inspection or processing.

In all cases every effort is made to delivery your order in a timely manner as soon as is reaches us for packing and forward shipping on to the buyer.

3.3 – Delivery Delays 

Essex Rotary LTD cannot be held responsible nor are we liable for inconvenience, loss or damages incurred due directly or indirectly to any delay in the delivery of your order.
To ensure your order can be processed in a timely manner and without unnecessary delays please make sure your delivery address is accurate and contains all the relevant information required.

  • Town
  • County/Province/State
  • Post/Zip Code
  • Country
  • Contact Phone Number (ad advise you use a mobile/cell number)

Please ensure all this information is accurate before you complete checkout via PayPal.

3.3 – Back-Order Items and Split Shipments

While we try our best to hole as much of our inventory in stock there are times when regular stock items have sold out. In these cases if it is an item we usually hold then it will be listed as “available on back-order”

If your order contains items that have been marked as “back-order” then once we receive your order it will be marked as “Items on back-order” and you will be notified via out shot system of this. If you wish for us to process a split shipment then please see section 3.3.2

3.3.1 Back-Order Items and Shipping Delays

Please remember that having items listed as available on back-order may delay your order being dispatched until these items are back in stock, our online store calculated the combined shipping cost of your order and as such in many cases we are unable to simply split the shipment and send everything that is in stock immediately and follow with the back ordered items as they arrive.

If you wish to get everything that is in stock immediately then we can offer a split shipment option, please see the below information in 3.3.2

3.3.2 Split Shipments

If you wish for us to ship in stock items from your order ASAP, please contact us and we will be happy to get you a brake-down of any additional shipping costs involved in splitting your order (some orders may be able to be split at no additional cost)

If your split shipment request incurs any additional shipping costs these need to be paid prior to proceeding with your split shipment in order to prevent any further delays later.


4. Availability and Accuracy of Pricing and Descriptions

Essex Rotary always try to make sure that the prices are accurate but errors may occur.
If we discover an error in pricing of the products in your order, we will inform you as soon as possible using the contact details you supply us with (So please ensure they are up to date).

We will then give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to reach you or do not receive a reply within 28 days, we will treat the order as cancelled. If an order is cancelled, any payment made for the products will be refunded in full.

Essex Rotary LTD aims to carry in stock the majority of items that are feature on the website, but due to the extensive nature of our range of car specific products, and the specialist nature of items, some items may become out of stock or are special order direct from the manufacturer. In the event of a delay in your order caused by an item being out of stock or specially ordered we will contact you by phone or e-mail to advise of the estimated delivery time, and in the case of specially ordered items we will confirm the deposit required. Some of our products are made to order and as such a time for manufacture is noted on the product page of the website. Payment for these goods is taken in full at the time of ordering.

Essex Rotary LTD may cancel any sale and not supply products if it is reasonable to do so or we suspect the order to be fraudulent.
Essex Rotary LTD  may change or discontinue the availability or description of products at any time at its sole discretion without prior notice.

4.1 – Accuracy of Descriptions and Images

While every effort is made to ensure the information Images and descriptions published to our website are accurate, all size’s given on this site are approximate dimensions only due to tolerances in materials we cannot give exact dimensions of the products, images shown on this site may not always be an exact image of the item and only a likeness example.

5. Returns Policy and 14 Day Cooling Off Period

5.1 – Damaged Goods

Essex Rotary LTD make every effort to ensure your goods are not damaged or incorrect before shipment and package goods to limit the potential for damage in transit. However if upon receipt of delivery you find that your goods have been damaged in transit, please notify us immediately by e-mailing sales@essexrotary.co.uk or by phone on 07880 913 505 (we are unable to accept voicemail messages as form of notification).
Replacement items will then be requested and sent to you. In the unlikely event that your items have a defect or is incomplete  e.g. missing parts, please advise us so we can arrange a dispatch of replacement parts to you as soon as possible.

5.2 -Faulty Goods

If upon receipt of delivery you suspect your item to be faulty Essex Rotary reserve the right to request the item or part of  the item damaged be returned to us in a timely manner for inspection to determine the cause of the fault, prior to offering a refund or replacement. In all cases all packaging should be retained and returned with the goods faulty.

5.3 – 14 Day Cooling Off Period

Once you receive your order you have fourteen days to decide if you wish to return it. However, providing the goods have been correctly supplied a 15% handling/restocking charge will apply, with the exception of any special order or made to order parts such as Wheels, Engines, Turbo Kits etc.and engines that made to order which are non-returnable.
The 14 days start from the day after the day that you receive the goods.
We will issue a refund equal to the value of the returned goods minus the handling charge stated above.

5.4 – Order Cancellations 

For orders that have been placed and the buyer wishes to cancel their order after all the processing has been carried out but, prior to shipping of your goods a 7% handling charge will be deducted from your refund total to cover processing and handling costs.
Special order or non returnable items cannot be cancelled once the order has been placed the supplier or manufacturer. If the order has not been confirmed with out supplier or manufacturer then the same 7% handling fee will apply.

5.5 – Buyers Responsibility for Returning Goods

The buyer is solely responsible for the safe return of goods under the 14 Day cooling off prior, The Buyer is also responsible for the cost of the return shipping, any additional insurance to cover the cost of the goods if lost and ensuring the items and adequately packaged to reach Essex Rotary LTD in a 100% re-sellable condition.

The ensure your return goes smoothly and without issue, Essex Rotary LTD would advice that all returns should be sent via the appropriate service and shipped via a tracked, insured and signed for service.

Goods must be in 100% re-sellable perfect condition and returned in their original undamaged packaging . We unconditionally reserve the right not to refund if the goods are not returned in a suitable condition. We regret that we cannot accept items that are or have been part or fully assembled so please ensure you are happy with the goods before you begin assembly or installation.

5.6 – Non Returnable Items.

Due to the nature of some items we regret we are unable to accept returns if the item was supplied correctly according to the buyers request/information provided, In most cases these items are special or or made to order items however in other cases its due to the delicate nature of the part.

Items that we unable to accept returns on Include but are mot limited to;

  • Special Order Items such as
    • Turbo Kits
    • Turbo’s
    • Engine Rebuild Parts or Kits
    • Wheels
    • Tyres
    • ECU’s
    • Exhaust Systems
    • Induction Kits
    • Clutches
    • Nitrous Systems/Parts and Components
    • Water/Methanol Injection Parts and Components
  • Made to Order Parts such as
    • Coupler Kits
    • Custom or Special Intercooler Kits
  • Fragile Parts such as
    • Final Drive Ring and Pinion Gears

While every effort is take to ensure that is it clearly stated if an item is non returnable in the items description, if you are unsure please contact Essex Rotary LTD via phone or email prior to placing your order.
Please ensure the non returnable parts you have ordered are correct for the application you are intending to use them for prior to ordering Essex Rotary LTD cannot be held responsible for non returnable items ordered in error.

In instances where the buyer has placed an order for a non returnable item, the buyer has automatically accepted the above terms stated in the “non returnable items” conditions above.

5.7 – Undelivered Goods Returned To Essex Rotary

Please note that all orders will be shipped to the provided delivery address during checkout, and deliveries will be booked using the details provided bu the buyer. Essex Rotary cannot be held responsible for deliver delays or undelivered orders resulting from the incorrect details being provided.
It is the buyers responsibility to ensure your goods are collected from the courier before they are returned to the sender (Essex Rotary), Each courier has a different perior they may hold your goods prior to attempting to return them. They may also attempt multiple delivery attempts prior to them being returned to sender.

In instances where goods have been returned undelivered by the courier be it due to an address error or the buyer not arranging to collect or redeliver the shipment. Essex Rotary shall hold the goods for a “holding period” of 60 days and attempt to contact the buyer to arrange redelivery or a refund. If Essex Rotary fail to make contact or get a reply after 60 days, the specific details and costs or refunds are detailed in section 5.7.4

Details of these services are set out in the next sections 5.7.1 – Redelivery, and 5.7.2 Undelivered Order Cancellation

Under no instances shall the original shipping costs be refundable and there may also be a return shipping cost due, depending on the courier and delivery location this may vary, Essex Rotary will be happy to advise this amount on a case by case basis.

5.7.1. Redelivery Costs

If the buyer wishes to have their goods redelivered then there will be an additional charge payable, this will be made up of the cost to delivery your goods (usually this will be the same as the previous shipping cost*) + any cost charged by the courier for the return of goods during the original failed delivery attempt.

*unless the cost of shipping has increased in the time between your original order and the time when we arrange redelivery.

5.7.2. Undelivered Order Cancellation

If the buyer wishes to cancel their order once goods have been returned, then an admin fee will be deducted from the refundable amount, made up of the the order handling/restocking fee detailed in section 5.3 + cost of return shipping charged by the courier + the original delivery cost. This amount will be deducted from the order total prior to your refund. Buyers will be notified of this amount prior to processing their refund so you know how much you will be due back.

This is not applicable if your goods fall under section 5.6 – “Non Returnable Items”

5.7.3. Undelivered Goods That are Non Returnable under section 5.6

If your returned parcel has goods that fall within section 5.6 “Non Returnable Items” then these will also be deducted from the refundable amount in full and the buyer will be liable for the redelivery cost of those goods payable prior to shipping it back out. In addition to any return delivery costs.

5.7.4. Returned goods without communication from buyer.

Exception to the terms set out in this section 5.7.4. are if your goods are non returnable under section 5.6 “Non Returnable Items” These goods will be held for a period of 180days before being classified as abandoned by the buyer, If no communication is made during this period Essex Rotary will dispose of these goods in the appropriate manner.

If the buyer makes contact and wished to arrange redelivery of these non returnable goods after the “holding period” set our in section 5.7 and before the 180 day storage period then the goods may be subject to a storage fee payable in addition to any other fees such as the goods return cost Set our in section 5.7.1. Redelivery Costs

5.7.4. Processing of Goods That have Not Yet Arrived Back At Essex Rotary

For orders to be processed under any of the terms set out in section 5.7, the goods must first have been received at Essex Rotary after being returned by the courier. Essex Rotary are not responsible for any delays or have no control over the time taken to return goods that where undelivered. This is why it is important for the buyer to ensure they are available to receive the goods, arrange collection or redelivery before the courier initiates a return to sender.

Once the courier initiated a return to sender, we are unable to stop this and must wait for them to arrive back at Essex Rotary for further processing.

Under no circumstances shall replacement goods be supplied*or any refund or redelivery be offered until the goods have been returned to Essex Rotary by the courier.

*Unless paid for under a separate order AND authorised as such in advance by Essex Rotary. Under these circumstances the refund amount will be subject to the admin fees laid out in section 5.7.1 with the exemption of the redeliver fee as this will have been covered in during the payment of the replacement order.

6. Goods Warranty

Whilst we make every effort to ensure that Goods supplied by us to you are suitable for use in your vehicle, any such opinion will be based entirely upon information provided by you with no inspection undertaken by us. As such, all such information or opinion is for indicative purposes only and should be checked and confirmed by you prior to placing an order.

Due to the unpredictable nature of the stress placed on vehicles (whether performance/competition vehicles, road vehicles or vehicles or any other nature), and our inability to monitor and inspect the installation, modification and use of any Goods supplied by us to you, we give no warranty (whether express or implied) in relation to the Goods, apart from:

Any warranty contained in these conditions;

Any specific warranty expressly confirmed in writing by us at the time of the relevant Confirmation;

Any warranty provided by the manufacturer of any Goods we sell to you (in which case your rights shall be against the manufacturer and we shall bear no responsibility or liability to you arising out of or in connection with any claim thereunder).

Any potential Engine warranty claim from the supply of an engine unit will require the engine to be returned at the cost of the customer for inspection.

Finally we would like say that here at Essex Rotary, we take your privacy seriously, it is important to us that you understand how we deal with your information, what we collect and for what reasons. Also who we share this information with. We would kindly ask you to review our privacy policy that can be found here.

Essex Rotary LTD reserve the right to amend or change these Terms and Conditions at the sole discretion of Essex Rotary LTD and without  prior notice, warning or consent of any third party or buyer.
